TERMS AND CONDITIONS OF SALE AND USE

1. Company and scope
These Terms govern the use of greenhouseseeds.com.br and purchases made on the website. The seller and operator is Ecommerce Logistics Solutions LLC, EIN 61-2216317, 1209 Orange Street, Wilmington, Delaware 19801, United States. Contact: brasil@greenhouseseeds.com.br.
The logistics partner located in Brazil acts solely in warehousing, preparing and dispatching orders and does not replace Ecommerce Logistics Solutions LLC as seller with respect to the customer.
2. Acceptance and capacity
By using the website or completing a purchase, the user declares to have read and accepted these Terms. The user must have legal capacity to contract and comply with any legal age requirements or other restrictions applicable to the product.
3. Legal use of products
Products are offered exclusively for purposes permitted by applicable legislation. The customer is responsible for observing the rules applicable to the acquisition, possession and use of products, without this excluding the seller legal responsibilities.
4. Information, availability and prices
We use reasonable efforts to keep descriptions, images, availability and prices correct. Manifest errors may be corrected. Before order confirmation, the customer will have access to the essential order information, including price and applicable delivery costs.
The prices and currency shown at checkout will be those applicable to the order, unless there is a manifest error or legal obligation to the contrary.
5. Orders and payment
Order completion is subject to payment authorisation, stock availability and anti-fraud or compliance checks. If an order is cancelled after billing, amounts will be reversed or refunded according to the payment method and applicable legislation.
6. Fulfillment and delivery in Brazil
Orders destined for Brazil are prepared and dispatched domestically by a logistics partner located in Brazil, on behalf of Ecommerce Logistics Solutions LLC.
Lead times, delivery methods, tracking, costs and other delivery conditions are detailed in the Shipping Policy.
7. Right of withdrawal
For purchases made outside a commercial establishment, including online, the consumer may exercise the right of withdrawal within the applicable legal period, counted in accordance with Brazilian legislation.
The withdrawal request must be communicated through a clear and accessible channel, including the email brasil@greenhouseseeds.com.br. When validly exercised, the returns and refund procedure will follow the Returns, Exchanges and Refunds Policy and applicable legislation.
8. Defective, damaged or incorrectly dispatched products
Claims for incorrect, damaged, defective products or fulfillment errors will be analysed in accordance with applicable Brazilian legislation. We may request the order number, description of the issue and reasonable evidence such as photographs, without creating undue obstacles to the exercise of legal rights.
9. Fraud and security
We may request additional checks, suspend processing or cancel transactions when there are reasonable indications of fraud, abuse or security risk, respecting consumer rights.
10. Chargebacks and disputes
We recommend that the customer first contacts us at brasil@greenhouseseeds.com.br so we can analyse and resolve any issue. This clause does not limit legal rights nor prevent the consumer from using legitimate dispute or defence mechanisms.
11. Intellectual property
Website content, including trademarks, texts, images, layouts and graphic elements, belongs to the respective rights holders and may not be used without authorisation, except as permitted by law.
12. Liability
No limitation of liability set out in these Terms applies where it would be incompatible with mandatory consumer rights or applicable Brazilian legislation.
13. Force majeure
Delays resulting from events beyond the reasonable control of the parties will be handled in accordance with applicable legislation, without prejudice to mandatory consumer rights.
14. Applicable law and jurisdiction
These Terms do not exclude the application of mandatory Brazilian consumer protection rules or the right to access the competent authorities and courts guaranteed by Brazilian legislation.
15. Changes and contact
